Divorce

In California, a Divorce is called a Dissolution of Marriage. This action terminates a marital relationship. Although it is a legal proceeding, it can also be a very emotional process. Whether you’ve been married 40+ years, or a few months, we recognize that obtaining a divorce is one of the most difficult issues our clients will face in their lifetimes. Many important decisions must be made that may have a lasting effect on your family, your assets, your finances, and your future. Issues that may arise in a divorce action may include child custody and visitation, child support, spousal support, division of property and debts and, sometimes, restraining orders. Divorce Coach: We can guide both you and your spouse through the procedures from the initial filing through judgment. We will draft, file, and serve documents, including a settlement agreement, in simple uncontested dissolutions. In this situation, we would not represent either party, and will not provide legal advice to either party. However, we can provide information to both parties so long as it is communicated to both parties concurrently.

Mediation: When the parties prefer not to go to court, they may, instead, agree to mediate any disputed issues. This process provides the parties with an opportunity to fashion an agreement that has certainty and finality regarding their family and their future. In mediation, we are neutral, and represent neither party. Therefore, certain rules and boundaries must be agreed upon and respected by all involved. We can provide information to both parties, but advice to neither party. Mediation is a confidential process. Because it is confidential, nothing that is said by anyone in mediation can be repeated or used by either party in any way in a court of law. That assurance of safety encourages open communication between the parties. Parties can express their feelings, needs, wishes, reasoning for their position, and listen to the other person without fear of being exposed, weakened, or vulnerable. Removing that fear often provides the parties the opportunity to discuss, negotiate, and recognize the other side of the argument and, eventually, find a compromise they can live with. As a trained mediator, we will assist the parties to express themselves, stay focused, remain courteous, and find common ground to resolve disputes. The Mediation process can be with parties who don’t have lawyers, or between parties who are represented by attorneys.

Negotiation: Even when you and your spouse cannot seem to find common ground, we can use our legal expertise, negotiation skills, and common sense to resolve disputes, protect your rights and ensure that all support agreements, property divisions, and custody arrangements are fair to you and your children so that you may avoid expensive and emotionally draining court proceedings.

Litigation: If disputes cannot be resolved through discussion and negotiation, we will provide aggressive representation in court proceedings. We have extensive experience and knowledge in all facets of divorce proceedings, whether at a custody or support hearing, a contempt hearing, or trial. We will keep you informed about the procedures relating to a court hearings in a contentious divorce.
