Domestic Violence Restraining Orders

In California, Domestic Violence Restraining Orders can be obtained against your current or former spouse, boyfriend/girlfriend, someone with whom you’ve had a child, someone you live or previously lived with, or someone you are related to through blood or marriage when they do one or more of the following acts:

  • Causes, threatens, or attempts to cause you physical injury;
  • Sexually assaults you;
  • Makes you fear that you or another person is in danger of immediate, serious physical injury;
  • Molests, attacks, strikes, batters (uses force), or stalks you;
  • Threatens or harasses you - either in person or through phone calls, emails, etc.;
  • Destroys your personal property; and/or Disturbs your peace.

If you believe you need protection from an immediate threat of harm, we can represent you in a Court hearing to obtain a Temporary Domestic Violence Restraining Order. Certain papers must be filed and served, and the person seeking the Order will have to appear in person to tell the Judge why they believe they need the protection.

At a second hearing, the judge will determine whether a “Permanent” Restraining Order is appropriate, which means it will be in effect for a longer period of time. The Court can issue a Restraining Order for up to 5 years.

You may obtain orders that the abuser move out of the home you share, that the abuser be prohibited from purchasing or possessing firearms, and that the abuser pay child support and/or spousal support. The Court may issue temporary child custody/visitation orders, and may order that the abuser attend batterer’s treatment program. These orders may protect you and other members of your household where you live, where you work, where you attend school, your car, etc.

If granted, a Restraining Order is a very serious limitation of a persons’s rights. It may have a negative impact on the accused’s current employment and future employment opportunities including security clearances.

Not every request for a Restraining Order is granted. The person who is accused of the bad acts will have an opportunity to tell the Judge their side of the story. It is important for both parties to understand their burden of proof, as well as procedures in this type of hearing.
